Brazilian lawmakers are considering a new restriction on betting deposits that would introduce a default monthly limit of R$80 for customers using licensed fixed-odds betting platforms.
Bill PL 3765/2026, introduced by Senator Camilo Santana, proposes amending Brazil’s Law 14.790/2023 to create a nationwide deposit ceiling linked to a bettor’s financial capacity. The legislation was formally submitted on July 16 and remains under consideration in the Senate.
Under the proposal, bettors would initially be limited to depositing R$80 per month across regulated betting operators. Customers seeking a higher threshold would need to demonstrate sufficient financial capacity, after which their limit could rise to a maximum equivalent to 5% of their verified monthly income.
The measure is designed to apply on a consolidated basis rather than separately at each betting company, preventing customers from bypassing the restriction by dividing deposits between several licensed platforms.
Any amount deposited above the permitted threshold would have to be returned immediately. The bill also gives the Ministry of Finance responsibility for periodically adjusting the standard limit to preserve its real value over time.
Santana presented the measure as a consumer-protection tool aimed at reducing gambling-related debt and excessive spending. Senate documentation points to deposit-control approaches used in European markets, including Germany and Belgium, as examples considered in developing the proposal.
Brazil’s federally regulated fixed-odds betting market has been operating under its full licensing framework since January 1, 2025. Companies offering betting nationally must receive authorization from the Ministry of Finance’s Secretariat of Prizes and Betting, while federally licensed websites operate through the country’s .bet.br domain system.
PL 3765/2026 was sent to the Senate’s Transparency, Governance, Oversight and Consumer Protection Committee on August 12. The period for submitting amendments ended on August 18 without any amendments being filed, and as of August 19 the proposal was awaiting the appointment of a rapporteur. It is subsequently scheduled to proceed to the Economic Affairs Committee.
The deposit-limit proposal is one of several betting-related measures currently moving through Brazil’s Senate. Other bills under consideration address issues ranging from financial transaction controls and compulsive gambling protections to significantly broader restrictions on betting activity.
